Residential Tenancies Act (“RTA“) and other statutes and regulations govern the disputes between the landlords and tenants.​

Under RTA primarily, Landlord and Tenant Board ("LTB") makes the decision. If you want to obtain the updated news and forms from LTB, please check out LTB website as indicated above.

How to decide if you have a claim to make? One of the fundamental issues to clarify at the beginning stage is whether or not there is a legal claim to be made. What people think might not be covered within RTA or settled through LTB; or sometimes, LTB do not have the jurisdiction to provide the judgment since the subject is not listed within RTA. If you are not sure if you have a claim or not, feel free to contact us for a half-hour consultation to clarify the issue.

LTB rules provide a great guideline regarding the general steps to be followed. Each claim or response has to follow specific rules to ensure the quality and consistence. If there are errors on the formalities (forms, service methods or termination date calculation), it is highly possible that the claim or response will be dismissed. Thereinafter, the landlord or the tenant may face delay. 

Government-issued forms shall be used for each claim or response. Individually prepared forms are sometimes admissible, however, using the government-issued forms would prevent possible formality errors.
